April 2018: Conference News & Updates

Dear Members

Together with our Executive, with the help of the Council and the STF2025 wing, we are redesigning INSOL Europe to be closer to its members and to be tailored around their needs. The Council meeting in Sibiu, 19-20 April, has helped tremendously to clear our minds and to choose a new direction for INSOL Europe.

One action, in order to attain this proposed growth, is to increase our local footprint by creating regional INSOL Europe representation. The main mission is increasing representation in INSOL Europe at a high professional level for all European practitioners; we will try to achieve this by sharing know how, promoting our programs and the High Level Course. In return this will help increase membership, spread INSOL Europe’s message locally, and also spread the national message at a European and international level and therefore increase INSOL Europe’s relevance and impact. Most European countries will have a local Director who will connect them to the organisation.

Another step will be taken regarding membership; we will create a tailor-made recruitment and fee strategy that will take into consideration the age, the professions and the location (especially for the countries with a low INSOL Europe penetration rate and with a big potential, taking into consideration their GDP). We have already started to focus on countries with more than ten members such as Luxemburg, Finland, Portugal, Belgium, Hungary (as a first wave). The target, as approved by the STF2025, is approx. 25% growth in membership – 1,600 members, in five years.

Together with our Brexit wing, we will make specific recommendations to the European Union that will help tackle all professional issues that will arise from this separation. 

And of course, we will continue to help young insolvency legislations with our High Level Insolvency Course. This is an important instrument of sharing our know-how at national local level and solidifying the prestige of INSOL Europe.

A new approach regarding social media, redesigning our website to be more user-friendly and rethinking the format of our main Congress are also under consideration.

As an insolvency practitioner it is always a balance to meet certain interests, but at the same time follow and use the different legal frameworks. That is why the title of our 2018 conference will be 'Balance of Interests: Restructuring, Insolvency and Second Chance'. The conference will be focused mainly on new approaches across Europe towards (cross-border) insolvency, how local and European laws have developed and the Commission's plans for harmonisation of the Member States' insolvency laws. 

We are pleased to announce that our Keynote Speakers for the 2018 conference in Riga are Latvia's Prime Minister, Māris Kučinskis, and Minister of Justice, Dzintars Rasnačs.

The conference will be preceded by an optional networking dinner (on Thursday 31 May) in a restaurant in the centre of the old town, during which the guests can have a taste of both Latvia’s culinary and music traditions. There will also be a Young Members Group drinks reception on Friday 1 June, details to follow soon.

This year our Technical Programme will feature themes such as 'The Holy Grail of Greek Insolvency Law' and 'Brexit - Are we prepared?'. Our Break-out Sessions will include topics such as 'E-mobility' and 'How to crack down on offshore companies'. High-Level Course on Insolvency Law 2018: All set for Cyprus

Following the successful first course in Romania, the second High-Level Course on Insolvency Law will begin in Cyprus in September at the Hilton Nicosia. The format will continue as last year with second and third modules, the dates of which are yet to be confirmed. 

The course will be opened to approx. 60 professionals involved in the insolvency practice of the jurisdiction, with special focus on high level lawyers and IPs, judges and state officials of the relevant insolvency agency.

Inside Story: Implementing the Recast EIR in Hungary

Council Regulation (EC) No 1346/2000 of 29 May 2000 on insolvency proceedings has been replaced by Regulation (EU) 2015/848 of the European Parliament and of the Council of 20 May 2015 on insolvency proceedings (recast) on 26 June 2017 (“Recast EIR”). The Recast EIR has not revolutionised European insolvency law. 

Instead, it codified the case law produced by European courts in the last more than one decade and addressed some further issues that emerged since the entry into force of the 2000 EIR. Notwithstanding, the Recast EIR undoubtedly made it necessary to adjust the domestic insolvency regimes on some points.

The Hungarian Parliament adopted some amendments (“Amendments”) to the Hungarian Insolvency Act (“HIA”) in October 2017. The purpose of the new legislation is to harmonise the domestic insolvency framework with the new provisions of the Recast EIR. While, admittedly, the legislative proposal went through significant improvements before adoption, there are still several legislative solutions that should be criticised.
