Dear Members

Last year we launched an ambitious training project: the INSOL Europe High Level Course on Insolvency, first held in Romania. The first edition was a success: we received the support and cooperation of the Minister of Justice, Ms. Raluca Pruna, and from the representatives of the National Institute of Magistracy, as well as the support of the National IPs’ Association. We put together a great team of international and local experts, including academics, IPs and judges. 

We decided to continue this success story, so after selecting from various options we decided upon the best location for the 2018 INSOL Europe High Level Course on Insolvency Law - Cyprus.

The Cyprus reform of the insolvency statutory framework in 2016 was included in the terms of the Memorandum of Understanding between the government of Cyprus, the International Monetary Fund, the European Central Bank and the European Commission agreed in 2013 during the banking crisis. The new insolvency regime mirrors to some extent the Common Law model which was adopted by Ireland and so, this course is well aspected by the local restructuring and insolvency stakeholders. There are around 300 IPs in Cyprus and a lot of insolvency procedures, as well as a very active NPL market. We hope to have an open debate with all participants, and to facilitate the communication between IPs, creditors, judges and estate representatives.
 
Fortunately, we also have the support of the national IPs association and we put together a great local team to help us organize it. We are doing our best not only to replicate our Romanian story, but to improve it in Cyprus. Preparations for the course are moving forward, and, if all goes as planned, we should begin the first module of the course mid year!

EECC Conference, Riga: Register now and save!

We are pleased to announce that our Keynote Speakers for the 2018 conference in Riga are Latvia's Prime Minister, Māris Kučinskis, and Minister of Justice, Dzintars Rasnačs.

As an insolvency practitioner it is always a balance to meet certain interests, but at the same time follow and use the different legal frameworks. That is why the title of our 2018 conference will be 'Balance of Interests: Restructuring, Insolvency and Second Chance'. The conference will be focused mainly on new approaches across Europe towards (cross-border) insolvency, how local and European laws have developed and the Commission's plans for harmonisation of the Member States' insolvency laws. The conference will consider the possibilities in different European jurisdictions for financing and other crucial tools to save as many companies as possible where there is a viable business.

Attending our conference presents an excellent opportunity to meet industry experts and to learn about the latest trends in insolvency. The conference will be preceded by an optional networking dinner (on Thursday 31 May) in a restaurant in the centre of the old town, during which the guests can have a taste of both Latvia’s culinary and music traditions.

Turton Award 2018: Win an all expenses paid trip to Athens

 

The Richard Turton Award provides an educational opportunity for a qualifying participant to attend the INSOL Europe Annual Congress, which this year will be held from 4-7 October 2018 in Athens, Greece.

The award is open to applicants who:

  • Work in and are a national of a developing or emerging nation;
  • Work in or are actively studying insolvency law and practice;
  • Are under 35 years of age at the date of the application; and
  • Have sufficient command of spoken English to benefit from the conference technical programme.

The successful applicant will be asked to write a paper of 3,000 words on a subject of insolvency and turnaround to be agreed with the panel. This paper will then be published in summary in one or more of the Member Associations' journals and in full on their websites.

Inside Story: Comments on Recent Reforms in Italy

During the past three decades, the gradual and fast tendency of the markets to “globalization” have determined the recent tendency of States to adopt legal provisions dedicated to the prevention of financial crises and to avoid insolvencies of market operators. In fact, the adoption of such measures is today one of the essential elements in the determination of international ratings for the evaluation of the integrity of internal market.

“Predictability” and “risk management” have gradually become common words, essential for the prevention of crisis, opening also the possibility for entrepreneurs to have a second chance and remerge in the markets after a “dark night” period. In this particular context, therefore, an efficient system for the resolution of issues related to insolvency becomes an essential task for a State in order to guarantee the right balance to the internal market of a country, also with the scope of attracting foreign interested investors and implement the economy.

To this extent, various States, including Italy, have recently started to move towards reform projects of insolvency law, in order to facilitate and speed up, efficiently, the approach to insolvency issues.
