Dear INSOL Europe colleagues,
As we move into the final months of 2026, I can’t quite believe my Presidential year is nearing its end. It has been a very rewarding and interesting 11 months so far! I know that my successor, Frank Heemann from Lithuania will be an amazing President (& I am quite jealous that he will soon take over). He has as Deputy President (as has Evert Verwey as Vice President) been a great support during my term to date and I already know our INSOL Europe succession will be successful, therefore.
Preparations for our Annual Congress in Vilamoura are gathering pace. Our Technical Committee led by Emmanuelle Inacio and Co-Chairs David Sequeira Dinis of Uria Menéndez, Portugal and Noor Zetteler of Wijn en Stael, The Netherlands, has once again developed an agenda that reflects both the challenges and opportunities facing restructuring and insolvency professionals across Europe. From economic uncertainty and geopolitical developments to the continuing evolution of preventive restructuring frameworks and cross-border cooperation, there will be much to discuss when we come together in Portugal.
Conferences are, of course, about far more than technical content. They provide an opportunity to strengthen professional relationships, exchange experiences and learn from colleagues facing many of the same issues in different jurisdictions. INSOL Europe has always thrived on that spirit of collaboration and friendship, and I am looking forward to catching up with many of you in Vilamoura.
Alongside preparations for the Congress, considerable work continues behind the scenes on the development of INSOL Europe itself. As an organisation, we must continually ensure that our structures, governance processes and ways of working remain fit for purpose. The growth of our membership, the increasing breadth of our activities and the expectations placed upon us require us to review how we operate and how we can deliver the greatest value to members.
The Council and Executive are, therefore, undertaking a number of initiatives following the Strategic Taskforce, but also focused on organisational effectiveness, performance and long-term sustainability. This is not change for its own sake. Rather, it is about ensuring that INSOL Europe remains agile, responsive and well positioned to serve members and support the profession in the years ahead.
Progress in any organisation depends on the commitment of individuals who are willing to contribute their time, expertise and energy. I would like to thank all those involved in our committees, projects and working groups for their continued support. I would also like to give advance thanks to our Congress Main Sponsor, Eight Advisory, as well as ongoing thanks to our General sponsors (Aon, Breal Group, CITR, Forvis Mazars, Infino Legal, Kellerhals Carrard, Teneo and Wedlake Bell) who enable so much of what we do.
I look forward to updating members further in Vilamoura and to discussing together how we can continue to strengthen our association for the future.

| Annual Congress 2026, Vilamoura, Portugal - Update |

INSOL Europe will bring its flagship Annual Congress to Portugal this autumn, with restructuring and insolvency professionals from across Europe and beyond gathering at the Tivoli Marina Vilamoura from 15-18 October 2026. Focus on: The Edwin Coe Open Forum in Coordination with the Judicial Wing
The technical sessions of the Academic Forum conclude on Thursday with the Edwin Coe Open Forum, which this year will be in Coordination with the Judicial Wing, open to all members of the main Annual Congress.
Chaired by Catarina Serra, the session will discuss 'Harmonisation Directive – Stress Points from the Judiciary’s View (Avoidance Actions, Duty to file, Pre-pack proceedings and Creditors’ Committees) with speakers Caterina Macchi (Judge of the Insolvency Division of the Ordinary Court of Milan, Italy), Dominik Skauradszun (Judge of the Insolvency Division of the Higher Regional Court of Frankfurt am Main, Germany), Fátima Reis Silva (Presiding Judge of the Commercial Division of the Lisbon Court of Appeal, Portugal), Flavius Motu (Judge of the Commercial Court of Cluj-Napoca, Romania), and Michael Quinn (Judge of the Commercial Division of the High Court, Ireland).
This will prove to be a lively discussion and a fitting end to the conference, which will finally be summed up with a closing address by the Academic Forum Chair, Jessica Schmidt.

| European Insolvency Regulation Case Register |
|
As a member of INSOL Europe, you have a free access to the European Insolvency Regulation Case Register which is a unique internet-based system for collecting and disseminating information on court decisions that consider a significant point relating to the Recast Regulation on Insolvency 2015/848 (or its predecessor, Regulation (EC) 1346/2000 on Insolvency Proceedings).

As at August 2026, the case abstract service provides abstracts published in English of 921 judgments including 91 abstracts applying the Recast Regulation on Insolvency 2015/848, including 1 from Austria, 8 from the CJUE, 11 from England & Wales, 7 from Estonia, 7 from France, 15 from Germany, 2 from Gibraltar, 5 from Italy, 20 from Lithuania, 2 from The Netherlands, 12 from Portugal and 1 from Scotland. Since the last update, additional judgments of the CJEU have been made available on the Lexis Nexis platform.
The Case Register committee is supported by a dedicated team of national contributors. All abstracts are published in English and are academically moderated by Professor Reinhard Bork. For information on how to access the register, please visit our website here.

| Focus on: INSOL Europe Anti-Fraud Forum |

The INSOL Europe Anti-Fraud Forum was established in 2012, with the following aims:
- To promote the use of insolvency processes to assist with the tracing and recovery of assets;
- To assess and review possibilities to address fraud and, more generally, (administrator) liability in the framework of insolvency scenarios;
- To share experiences amongst members of the group; and
- To provide a forum to educate a wider audience on the threats of fraud.

| National Insolvency Statistics Update - Latvia (2026) |

According to the Insolvency Control Service, as of the beginning of 2026, there were 872 corporate and 1,292 individual insolvency proceedings in Latvia. At the same time, 150 legal protection proceedings (restructuring proceedings) were underway.

The data point to a moderate decline in corporate insolvencies. In 2025, compared with 2024, both the number of cases initiated and the number of corporate insolvency proceedings declared fell. In total, 345 corporate insolvency cases were initiated, 6% fewer than in 2024, while 269 proceedings were declared, representing a 5% year-on-year decrease.
At the same time, the ratio of declared legal protection proceedings to declared corporate insolvency proceedings increased to 14% in 2025, up from 10% in 2024.
The average duration of insolvency proceedings increased to 2.04 years in 2025, compared with 1.8 years in 2024. So-called “empty companies” continue to have a significant impact on recoveries: in 52% of cases in 2025, insolvency administrators drew up a report on the absence of assets, up from 49% in 2024.
A decline was also observed in individual insolvency proceedings. In 2025, 562 individual insolvency proceedings were declared, 23% fewer than in 2024. This downward trend has been evident since 2021. In the Insolvency Control Service’s opinion, the decrease is most likely linked to the increase in the statutory minimum monthly wage, which has also raised the deposit required to commence individual insolvency proceedings, as that deposit is set at the level of two minimum monthly wages.
The recovery rate for unsecured creditors improved in 2025 to 20 cents on the euro, compared with 16 cents in 2024. By contrast, the recovery rate for secured creditors fell to 51 cents on the euro, down from 67 cents in 2024, thereby returning to the 2023 level. Insolvency proceeding costs in 2025 amounted to 42 cents per euro recovered, compared with 37 cents in 2024.
