Technical series publications

INSOL Europe offers a range of publications in our Technical Series, arising from events organised by the INSOL Europe Academic Forum and the Judicial Wing of INSOL Europe.

The publications from conferences contain papers delivered by speakers and panellists, as well as ancillary texts (draft laws and rules) debated at the conferences. The texts form a comprehensive report of the conferences and contain accounts of recent research in the insolvency field that are useful for both academics and practitioners.  Members of INSOL Europe are entitled to one complimentary copy of all of the publications, on application, and are €20 each for non-members.

When West Meets East: Bridging Europe’s Insolvency Regimes
Papers from the INSOL Europe Academic Forum Conference, Vienna, 8-9 October 2025

This volume comprises selected papers presented at the INSOL Europe Academic Forum and at the YANIL workshop in Vienna. The chapters herein detail the key discussions of the event and offer further insight into the evolving regulatory debate on insolvency law in the European Union. The book opens with a chapter by Anna Joubin Bret (Director, International Trade Law Division, Office of Legal Affairs of the United Nations and Secretary of UNCITRAL), who delivered the keynote speech at the event. In her chapter, the author examines the growing impact of digitalisation on insolvency law, both at the domestic and cross border level. The remainder of the book is divided into four parts.
  • Part I focuses on the systemic and cross border architecture of insolvency law, examining the regulatory foundations and coordination mechanisms that underpin cross border insolvency practice.
  • Part II focuses on the linkage between insolvency and arbitration, addressing the structural tension between insolvency law’s preference for centralised adjudication and arbitration law’s commitment to party autonomy and decentralised dispute resolution.
  • Part III focuses on governance failures, directors’ duties and behavioural insights, addressing the persistent gap between the formal design of insolvency law and the way in which key actors behave in practice.
  • Part IV, the fourth and final part of the volume, addresses insolvency, public interests and redistribution beyond creditors, bringing to the fore broader societal, environmental and public law dimensions of insolvency proceedings.
Taken together, the contributions in this volume illustrate both the increasing complexity of contemporary insolvency law and its evolving role as a framework for mediating between private ordering, public interests and global economic integration.

The Evolution or Revolution of European Insolvency Law
Papers from the INSOL Europe Academic Forum Conference, Sorrento, 2-3 October 2024

The twentieth INSOL Europe Academic Forum, held in October 2024, explored the theme “The Evolution or Revolution of European Insolvency Law,” with papers from the event compiled in this volume. The book opens with Prof. Stefania Bariatti’s keynote on the historical and legal development of the European Insolvency Regulation, followed by contributions examining pre-pack procedures, cross-border insolvency comparisons, and the impact of climate change and ESG considerations on insolvency frameworks. It concludes with a critique of the European Commission’s approach to harmonising directors’ duties. The volume captures current debates and evolving perspectives on EU insolvency law.

The Perpetual Renewal of European Insolvency Law” was the focus of the discussions held at the nineteenth INSOL Europe Academic Forum Annual Conference on 11-12 October 2023. The landscape of European insolvency law is in a state of constant evolution, driven by the need to address the complexities of a dynamic and interconnected economic environment. These conference proceedings seek to explore and illuminate the multi-faceted nature of insolvency law within the European context, highlighting its continuous development and adaptation in response to both internal and external challenges.
