Postępowanie o zatwierdzenie układu

Court confirmation of an arrangement plan previously voted upon by creditors.
Two options available for the arrangement plan: 
1 – affecting all creditors, or
2 – affecting certain groups of creditors (e.g. financial, highest value), but not others

Przyspieszone postępowanie układowe

Simplified court proceedings for accepting an arrangement plan. 
Two options available for the arrangement plan: 
1 – affecting all creditors, or

Court proceedings involving all pre-opening creditors accepting an arrangement; pre-opening security measures available.

Postępowanie sanacyjne

Most complex preventive court proceedings with the possibility of restructuring the debtor’s business before accepting an arrangement plan.

  •  by default debtor no longer in possession.

  • creditor may file for opening of proceedings, if the debtor is insolvent.

Elements of the Directive which may be included into the national legislation

A totally new restructuring law (covering the above four proceedings) and an amended bankruptcy law have been in force since 1 January 2016, fulfilling, in general, the draft Directive’s requirements.
 
Changes expected in 2018 include amendments to the law regulating the IP profession and changes to personal (individual/consumer) bankruptcy law.
 
There is currently no information in the public domain about any planned major reforms of the insolvency laws.
 
Areas where one may expect to see new or revised regulations in the future would include:

  • insolvency proceedings involving group member companies,

  • and/or provisions on directors liabilities during restructuring proceedings.
